All prices quoted are subject to VAT (where applicable) at the prevailing standard rate.

Payment Conditions

Non ‘credit account’ P & A MEDICAL customers are required to pay in full at time of ordering.

Delivery, Title and Risk

Any time or date stated for delivery is an estimate only. P & A MEDICAL makes every effort to despatch goods on time, but does not accept liability for failure to deliver within the stated time. If P & A MEDICAL is unable to deliver the goods within 30 days of the date of the order, unless pre agreed, the Customer will be entitled to cancel the order and require any monies paid to P & A MEDICAL in respect of that order to be refunded.

  • P & A MEDICAL does not accept liability for shortages or damage to deliveries unless the Customer notifies P & A MEDICAL of the shortage or damage in writing within 7 days of receipt of the delivery.
    (2) Delivery is deemed to take place when the goods are delivered to the Customer’s nominated address, whereupon the risks of loss, breakage and all damage shall pass to the Customer.
    (3) Title in the goods does not pass to the Customer until payment is received in full by P & A MEDICAL.
    (4) The Customer has to accept the goods when they are ready for delivery.
  • P & A MEDICAL does not accept liability for damaged goods that are returned to the Customer if, when sent to the Company for service, the goods were not dispatched in the originally supplied protective case.

If the Customer cannot accept delivery, P & A MEDICAL may at its option: Store and insure the goods at the Customer’s expense and risk or sell the goods at the best price reasonably obtainable and (after deducting reasonable storage insurance and selling costs) pay to the Customer any excess over the sale price or charge the Customer for any shortfall.

Warranty and Warranty Period

  1. Goods are supplied according to the descriptions and specifications given in the relevant and current price lists of the Company. The Company gives no warranty and makes no representation as to the suitability of fitness of any goods for any particular purpose unless expressly given or made in such price lists or websites.
  2. In the event that an item is defective within the meaning of the Sale of Goods Act 1979 (as amended from time to time) the Company reserves the right to replace or repair the goods as an alternative to refunding the purchase price, at its absolute discretion.
  3. Claims will not be considered where:

3.1 The goods have been improperly altered in any way whatsoever, or been subject to misuse or unauthorised repair;

3.2 The goods have been improperly installed or connected;

3.3 The goods have been opened, partly used or the seals or labels have been removed or tampered with;

3.4 The goods have been damaged by fire, water, smoke or chemicals;

3.5 Any maintenance requirements relating to the goods have not been complied with;

3.6 The goods have been specifically ordered by the Customer

3.7 Any instructions as to the storage of the goods have not been complied with in all respects;

3.8 The Customer has failed to notify the Company of any visible or suspected defects or damage within 7 days of delivery where the defect or damage should be apparent on reasonable inspection, or within 9 days of the same coming to the knowledge of the Customer where the defect or damage is not one which should be apparent on reasonable inspection.

  1. Any returned goods must be accompanied by a returns note, which the Company will supply to the Customer upon request. Failure to do so will render any claim for credit null and void. Any credit will only be raised after satisfactorily passing inspection by the Company’s distribution centre.
  2. The complete packaging should be retained if pilfering is suspected or if a breakage has occurred. If pilfering is suspected the Company and the carriers should be notified immediately. Claims cannot be considered unless these conditions are observed.
  3. Nothing in these terms and conditions excludes the implied terms under the Sale of Goods Act 1979 as to satisfactory quality and title in respect of Goods sold under these terms and conditions. All Goods that require calibration have been calibrated and are certified in accordance with all applicable technical standards (IOS, ATS, ERS etc.). Except as set out in this condition, the Company hereby excludes to the fullest extent permissible in law, all conditions, warranties and stipulations, express (other than those set out in the Contract) or implied, statutory, customary or otherwise which, but for such exclusion, would or might subsist favour of the Customer.

Carriage Charges

  1. All orders are subject to a transport charge at the discretion P & A MEDICAL.
  2. Any orders that are not to main land UK will incur additional costs. These will be advised to the Customer prior to the Order being despatched.
  3. Goods shipped direct from suppliers may be subject to additional carriage charges. Any additional charges will be advised prior to the Order being despatched to the Customer.

Non-Delivery

In the event of non-arrival of goods, Customers must inform the Company within 14 days of the date of the invoice or advice of despatch, otherwise no claim can be considered.

Returned Goods

  1. Goods are not supplied on a sale or return basis. If any Goods are returned, the Goods must be unused and in original packaging and fit for resale. Returns will only be accepted with prior written permission of the Company. This must be obtained within 7 working days of date of delivery.
  2. Items made to Customer’s own specification or have been specifically ordered will not be accepted for return unless faulty in accordance with the WARRANTY AND WARRANTY PERIOD, see above. Unless agreed with supplier such returns are subject to any charges and transit costs imposed by suppliers.
  3. The Company accepts no responsibility for goods lost during transit.
  4. No replacements are available whilst goods are exchanged, replaced or repaired.
  5. Goods will not be acceptable for return if they have been relabelled or used in any way, or if any tamper evident seals have been broken. A returns note needs to be provided by the customer in connection with all returns of non-faulty goods.
  6. Non-faulty goods are accepted back for credit at the sole discretion of the Company and will be subject to a handling charge of 25% of the net invoice value or a minimum charge of £25, whichever is the greater.
  7. All goods must be opened and inspected within 7 days of receipt. Failure to do so may result in credit/refunds not being issued.

Reconditioned Equipment

P&A Medical only supplies screening devices that are fully functional and calibrated to within the required standards. Each reconditioned purchase comes with free technical support and a 1-year limited warranty on parts and labour. Exclusions include 1. Cup cushions, 2. Headset leads, 3. Spirometry turbines, 4. Patient response buttons, 5. Related consumables. Devices must only be used with the power supply provided. The list of peripherals included with the device can be viewed when selecting the device from its product page. Consumables are available at an additional charge.

Below is the key for the condition of each listed product.

Condition: “Excellent”

  • Device looks close to new, i.e only the lightest signs of cosmetic wear
  • Visually, the device is in excellent condition, though some light scratches, marks and/or scuffs may be visible
  • Device is in full working order and, where applicable, has been calibrated to within the required standard

Condition: “Good”

  • Device is in good overall condition
  • Visually, the device shows some clear signs of wear, including scratches, marks and/or scuffs
  • Device is in full working order and, where applicable, has been calibrated to within the required standard

Condition: “Well Used”

  • Device shows significant signs of cosmetic wear, including numerous scratches, marks and/or scuffs
  • Device is in full working order and, where applicable, has been calibrated to within the required standard

Liability

P & A MEDICAL shall under no circumstances be liable for any consequential or indirect damage or loss, however caused, including (but not restricted to) loss of profits, loss of goodwill, damage to trading relationships, and financial loss. Without prejudice to the foregoing, where P & A MEDICAL’s liability to the Customer falls within the scope of any insurance policy held by P & A Medical (e.g. product liability insurance, professional indemnity insurance), P & A MEDICAL’s liability to the Customer shall be limited in accordance with the applicable limits (per occurrence or in aggregate) contained in the relevant insurance policy. P & A MEDICAL’s liability in respect of all other losses shall be limited to the invoiced value of the relevant order. Nothing in these Terms and Conditions shall operate so as to exclude or in any way limit either party’s liability for fraud, or for death or personal injury caused by its negligence, or any other liability that may not be excluded for limited as a matter of English law.

Calibration Services

  1. The Company will, at the Customer’s request, test any equipment specified by the Company for functionality, accuracy and safety. All work carried out by the Company will be in accordance with the manufacturers’ and/or governmental guidelines and standards (IOS, ATS, ERS etc.) and the Company will calibrate the equipment to comply with such guidelines and Standards where necessary (“Calibration Services”). Following its provision of the Calibration Services, the Company will issue the Customer with a certificate for each item of equipment tested indicating if the equipment has passed or failed. When items of equipment have passed this means that such items have met the minimum acceptable standards at the time they were tested. It does not confirm that the equipment will continue to function correctly. It is the Customer’s responsibility to keep equipment maintained and free from other defects.
  2. The extent of the calibration will be such as to cover all ranges and functions of the equipment, including, where relevant, linearity and frequency response. Where previous certificates have been supplied by the Company for the same item of equipment, then the same points will normally be used. Specific calibration points or any other special requirements that can be accommodated will be confirmed in writing prior to calibration. Where any area of doubt arises regarding calibration points the Customer will be contacted for clarification.
  3. The Company warrants that any instrument calibrated by the Company found to be out of tolerance within six (6) months for electronic instruments and thirty (30) days for mechanical instruments due to defects in the Company’s repair or calibration processes will be recalibrated at no charge to the Customer.

On-Site Services

Cancellations within 48 hours of a planned site visit will be subject to our minimum charge per site visit of £ 182.00

The same charge will be levied if we arrive on site and we are not granted access.

Charges for cancellations are made at the company’s discretion.

In-House Services

All turnaround times are approximate and are not guaranteed. Transit times to and from our laboratory are not included in the turnaround times.

The priority 24-hour service incurs a charge per item of £25 in addition to the calibration fee (excluding Blood Pressure Monitors).

Repairs are not included in the turnaround times and not eligible for the 24-hour priority service. Though we make every effort to complete repairs as soon as possible, we cannot provide an accurate timeline for completion until we have received the instrument(s) and identified the cause.

Though not required, it is advised that customers submit a Calibration and Repair Form before any instruments arrive at our laboratory. Failure to do so may result in delays to booking in and/or completing the required work.

All instruments, peripherals, accessories and leads should be noted on the Calibration and Repair Form. P&A Medical does not take responsibility for the loss of any items that are not listed.

You authorise P&A Medical to contact you by phone, text message or email regarding the work being carried out at our laboratory.

Repairs are only completed once parts and prices have been confirmed with, and authorised by, the main contact. P&A Medical will never complete a repair without authorisation, unless otherwise agreed.

Calibration charges apply whether an instrument is considered to have Passed or Failed. When an instrument has failed its calibration, P&A Medical may recommend a replacement instrument.
